Unfortunately there are too many stories over the years of people (mainly in America) successfully suing a company because said company did not design the product with idiots in mind.
10m$ is stupid but I can see some kind of damages if the story is true. If he told then he never used an EV, and sales person set to car to insane mode without saying anything, then thats seriously setting up a trap for the driver. They wouldnt have any idea how fast the car would have accelerated as it would be way beyond their expectation.

Well, if a car has “Performance” in the name, that should be a clue that it’s probably capable of very fast acceleration.
Just because it’s in insane mode doesn’t mean the throttle has lost all ability to throttle. This is basically someone suing because they mashed the pedal and it was faster than expected so they crashed. Thats like blaming the company for making the car too fast. The only reason this is even an issue is because it’s called “insane” and so lawyers were waiting for the right person, in this case an “innocent older lady” so they could show how irresponsible Tesla is.

I’m sorry I lost brain cells reading this article. She was at the controls of the vehicle. It’s her fault. It doesn’t matter if it was a Tesla or a Hellcat. You are the one at the controls, everyone knows EV’s have instant torque. Now I’m not a fan of one pedal driving and turn it off on my EV but one pedal is not going to cause you to loose control. This lady needs to look in the mirror if she wants to put the blame on anyone.

people can be told and people can tell you they "know" about it, that doesn't mean they actually understand how violently fast an EV can be if you mash the pedal like you stole it. It also depends on what kind of car they're used to drive, I've had the displeasure of driving some ICE automatics that really did not want to even start moving unless you depressed the go pedal a long, long way, so far that any EV would have you launched into the stratosphere. That's probably not very typical, but I'm just saying that it is possible that this person had a different idea of what "gently" accelerating means with respect to pedal input as you and I have

Will be interesting to see whether Tesla fights this or just pays then to go away, lawsuits are really expensive to defend in America - especially since the person sueing almost never has to pay the other side's court costs even if they loose.

Um, if you’re old and suck at driving, maybe don’t test drive the Performance version? Now they probably ruined it for the rest of us and Tesla will lock test drive vehicles in chip mode, which is probably fine most of the time, but if you’re test driving a Performance model, you probably want to feel how much power it has.
The problem is that it was already sweet to performance mode and the driver wasn’t aware.
The pedal feel in chill mode is terrible, if it was only less performance available that would be okay-ish, but there's also a delay that I dislike greatly.

Yeah, you can dial in as little as 1kph if you want, they don't exaggerate "throttle" tip-in with their mapping. Conversely, if you plant your foot, you're getting everything it's got *right now*.
Reminds me of my mom when the sales agent told her to move forward a bit in a wuling that was in sports mode... Parked in the showroom... She was so shocked, she still traumatized and doesn't want to drive an electric car. I even showed her my electric car in eco mode is gentle... Nope nope nope.

My first ever EV experience was test driving a Polestar with the performance package. I told the salesman I had never driven an EV before and he did the same thing, going through the menu to turn on all the performance features. Now… in any car I’ve never driven before, I will gently apply pressure to the gas and get a feel for the acceleration. Then I went to accelerate to merge in to faster traffic and went *flying*. It was kind of scary, but also the moment I knew I was done with ICE cars lol. I think putting the car in Insane mode to a person that’s never driven an EV is a mistake that should make the dealership partially responsible. But not $10m + $350k in damages. Common sense says to take it easy with acceleration during a test drive until you get to an open road. But common sense also says the salesman should have offered a warning about Insane mode to someone that’s never experienced the instant torque of an EV.
Polestar was also my first EV experience. What a beautiful machine that will ruin all ice cars for you. (Very irresponsible salesperson though!).
If you think the dealer is responsible, note that the 10M is compensatory. The punitive portion is the 350k. I have no idea if the injuries are worth 10M, but if you are at fault and cause 10M in damage that’s what you owe. You can get to 10M pretty quick with serious injuries and loss of future income.
My first one was I think somewhere around 2012. Did an internship at a local radio station and they sent me to cover the inauguration of the first fast charger in our city. Press was invited for a quick spin of a Smart EV on site. Was fun, but back then of course nowhere near the range figures we have today.

Eh they will look at the vehicle logs and see that accelerator was at 100% and that would be that. Tesla does need to do better education though. I like their hands off approach but they need to make sure that someone new to EV’s is well educated before getting in.
I’ve done a few demo drives and they’ve always asked if I wanted them to come with me if I wasn’t familiar with EV’s or Teslas. I always politely declined because I much prefer taking a test drive without someone distracting me.

She floored the pedal through a salon after already experiencing the power on the freeway. Don't make me laugh... She felt stupid for doing that or did it on purpose and didn't want to pay the damages to the vehicle or the salon and wanted a payout. She put it in drive instead of reverse is more likely the case.

Some people's brains completely shut off during insane acceleration. They freeze. The reflex to stop the acceleration triggers. The panic makes them push the brake as hard as they can in a desperate attempt to stop the vehicle, but it continues to accelerate. Sometimes they figure it out. Sometimes they crash before they can figure out it was the accelerator the whole time. There are two types of people in the world. Those that have experienced a pedal misapplication, and those that can't possibly understand how it could happen because it hasn't happened to them yet.

Ok. First of all, the Insane acceleration mode is only available on the *Performance* model. So, why was she test driving a performance model of a car if she was incapable of handling a performance car? Perhaps, the salesman believed that she was interested in performance since she chose to test drive the *Performance* .odel of the Model Y?
